An appeals court in the State of Michigan has upheld the misconduct conviction of a Detroit police captain who allegedly made two police officers wash and stain a personal outdoor deck at his home.

The police captain, Harold Rochon, is now retired. In 2018, he was convicted of misconduct while in office and received 60 days in jail.

It was in the summer of 2015 when investigators said the two officers who worked under Rochon were given orders to clean and stain the deck over the course of two days.

"Both officers testified that they did not want to do the work but were repeatedly told to do it and feared retaliation by (Rochon) if they reported him," the appeals court said.

In arriving at the conclusion to convict the former police captain, the court said there was "sufficient evidence" to do so.

The work done on the deck was discovered in 2016 during an internal police investigation.
